1. Who We Are

Creato Ltd is a company registered in England and Wales (Company No. 17307961), with a registered address at 124-128 City Road, London, England, EC1V 2NX ("Creato", "we", "us", "our").

We operate Creato Studio at creatostudio.io ("the platform"), an AI-powered tool that helps content creators generate scripts from video content.

2. Eligibility

You must be at least 13 years old to use Creato Studio. If you are under 18, you confirm that you have your parent or guardian's permission to use the platform. If you are subscribing to a paid plan, you must be at least 18 years old and legally capable of entering into a contract.

By using the platform, you confirm that the information you provide is accurate and that you are not barred from using the service under applicable law.

3. Your Account

You are responsible for keeping your login credentials secure. You must not share your account with others or allow others to access the platform through your account.

You are responsible for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at info@creatostudio.io.

We reserve the right to suspend or terminate accounts that violate these terms.

4. What the Platform Does

Creato Studio uses AI to extract content from publicly available videos on Instagram, TikTok, and YouTube and generate script variations for your own content creation.

We do not guarantee that scripts generated will perform well, go viral, or achieve any specific result. AI-generated content is a starting point — editorial judgement remains yours.

4a. AI-Powered Features

Creato Studio uses artificial intelligence, including large language models provided by Anthropic (Claude), to generate scripts, suggestions, and content ideas. By using the platform, you acknowledge that:

• AI-generated outputs may not always be accurate, complete, or suitable for your specific purpose
• You are responsible for reviewing and editing any AI-generated content before publishing
• We do not use your submitted content to train AI models
• The AI features are disclosed in our Privacy Policy and are a core part of the service you have subscribed to

5. Acceptable Use

You agree not to use Creato Studio to:

• Infringe the intellectual property rights of others
• Generate content that is defamatory, harassing, hateful, or unlawful
• Scrape, resell, or redistribute outputs from the platform at scale as a competing service
• Attempt to reverse-engineer, hack, or disrupt the platform or its infrastructure
• Submit URLs to content you do not have the right to analyse
• Use the platform in any way that violates applicable law or regulation
• Create multiple accounts to circumvent usage limits or bans

We reserve the right to suspend or permanently ban any account found to be in breach of these rules without notice or refund.

6. Intellectual Property

Your content: You retain ownership of any scripts, notes, and outputs generated through your use of the platform. By using the platform, you grant us a limited licence to process your submitted URLs and transcripts solely to provide the service.

Our platform: The Creato Studio platform, including its design, code, branding, and features, is owned by Creato Ltd. You may not copy, reproduce, or create derivative works from any part of the platform without our written permission.

Third-party content: Videos and content from Instagram, TikTok, and YouTube remain the property of their respective creators and platforms. You are responsible for ensuring your use of analysed content complies with the original creator's rights and the platform's terms of service.

6a. Creator-Inspired Style Profiles

Creato Studio offers a "Creator-Inspired Style" feature that provides AI-generated writing style profiles based on publicly known content creators. By using this feature, you acknowledge and agree to the following:

• No affiliation or endorsement: Creato Studio is not affiliated with, endorsed by, sponsored by, or in any way connected to the creators listed. Their names and handles are used solely for identification purposes.
• AI-generated profiles only: All style profiles are AI-generated interpretations for creative inspiration. They do not reproduce the creators' actual content and do not constitute a claim of ownership over their voice, brand, or intellectual property.
• Style is not copyright-protected: Writing style and tone are not protected by copyright. This feature assists users in writing content inspired by a creator's general style, not in reproducing or impersonating their specific works.
• User responsibility: You are solely responsible for how you use any generated content. You must not use outputs to impersonate, defame, or misrepresent any creator, or in any way that infringes their rights.
• Removal requests: Any creator who wishes to be removed from this feature may contact us at info@creatostudio.io and we will process the request promptly.

7. Subscriptions and Billing

Access to Creato Studio requires an active subscription. Payments are processed securely through Stripe.

• Prices are displayed clearly at checkout and may change with 30 days' notice
• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel at any time; access continues until the end of the current billing period
• We do not offer refunds for partial billing periods unless required by law
• Pilot subscribers are locked in at the price they subscribed at for as long as their subscription remains active

8. Creato Sounds — Licensing

Creato Sounds provides royalty-free audio tracks for use in your content. By accessing or downloading tracks through Creato Sounds, you agree to the following:

• Personal and commercial use: Active subscribers may use tracks in their own social media content, videos, and online platforms for personal or commercial purposes.
• No redistribution: You may not resell, redistribute, sublicense, or share downloaded tracks with third parties.
• No resale: Tracks may not be sold or included in products where audio itself is the primary item being sold (e.g. sample packs, music libraries).
• Attribution: Attribution is not required but appreciated.
• Subscription required: Access to downloads requires an active Creato Sounds subscription. Cancelling your subscription does not revoke licences for content already published using a track.

Tracks in the Creato Sounds library are original works. If you believe any track infringes a copyright, contact us at info@creatostudio.io and we will investigate promptly.

9. Availability and Changes

We aim to keep Creato Studio available at all times but do not guarantee uninterrupted access. We may perform maintenance, apply updates, or experience outages beyond our control.

We reserve the right to modify, suspend, or discontinue any feature or the platform as a whole at any time. Where possible, we will provide advance notice of significant changes.

10. Limitation of Liability

To the fullest extent permitted by law:

• Creato Studio is provided "as is" without warranties of any kind
• We are not liable for any loss of data, revenue, profits, or indirect or consequential damages arising from your use of the platform
• We are not responsible for downtime of third-party services we depend on (Apify, Anthropic, Supabase, Google, Notion)
• Our total liability to you in any 12-month period shall not exceed the amount you paid us during that period

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

11. Indemnity

You agree to indemnify and hold harmless Creato Ltd, its directors, employees, and agents from any claims, losses, or expenses (including legal fees) arising from your breach of these terms or your misuse of the platform.

12. Third-Party Services

Creato Studio integrates with third-party services including Google, Notion, Apify, and Anthropic. Your use of those integrations is also subject to the respective third party's terms of service. We are not responsible for those services or their availability.

13. Termination

You may delete your account at any time. We may suspend or terminate your account if you breach these terms, with or without notice depending on the severity of the breach.

On termination, your access to the platform will cease. Your data will be deleted in accordance with our Privacy Policy.

14. Governing Law and Disputes

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating legal proceedings, we encourage you to contact us at info@creatostudio.io so we can try to resolve the issue informally.

15. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email or by displaying a notice on the platform at least 14 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance.
